MP charter rights?

The Supreme Court of New Guinea ruled that for any party to tell its members how to vote, violates their constitutional right to freedom of expression and their ability to represent the wishes of their constituents.
Sounds like a similar ruling could be argued for here in Canada, under the charter of rights and freedoms. That would stop the drift towards Canada becoming a Prime Ministerial dictatorship. Canada has been called "The Friendly Dictatorship " for that reason. It would put a permanent crimp in any prime minister's dictatorial, control freak aspirations .
It would also rule "Unconstitutional "the requirement for a party leader to endorse a constituency's choice of candidate.
I can't see any valid reason to support the argument of "Necessity " overuling charter rights in this case.
This would be a good case for the court challenges program , which is probably why Harper canceled it.
Do any of you constitutional lawyers have any comment on the idea?
