It's my understanding that an MP has exactly the same powers as an RCMP constable does, on federal/crown land. However, they are expected to surrender the detainee to civilian authorities ASAP.

I'm working on the assumption of the offence being off crown land and a 25 km security perimeter would not be considered crown land in this instance.

The caveat to that being fairly obvious here and that is on DND land. Had that happened outside DND lands then when it finally arrives in civilian court the charges would be duly thrown out of court and rightly so. Their authority stems only from the civilian charge.

The problem with that is that the world (nor Canada does march to the beat of your drum. Within 50 Km of a DND base an MP can bust you for speeding, failinbg to stop DUI etc....and the charges will stick.

If you're a civilian and caught speeding while DUI by a MP they can and will detain and process you. The authority they have at that point is no more than a private security guard that detains you for a break and enter on land under their charge. The MP may also show up at your court appearance as a material witness but your charges will be handled by civilian law enforcement not the MP. The charges could be thrown out of court if the transfer was in any way bungled.

Members of the military other than MP's can be given law enforcement powers as directed by the Province in an aid-to-civil power context.

During the Red River flood in '97 my Troop was given those powers to protect the citizens and property within my AOR (which except for two towns and some farms was pretty much under water). We never had to use them.


I saw (on live TV) the Canadian Army snipe an armed robber in Victoria in 2001. There was no discussion, no negotiation, and no hesitiation: the sniper got in position and immediately took the shot - ending a volatile hostage situation.

I wish I could the same down here. :wink:

Not sure about in Canada but in the USA they do have radar guns and Breathalyzers at the MP station.

Let's say that there is a military base and for the sake of argument there are bars in a nearby city. The bars are frequented by military personnel and on occasion they will go out in groups and partake in the nightlife with civilians. MP's will frequently shadow such events as it is apart of their duties. Let's say that on the way to or from there an MP sees a vehicle clearly driving erratically, what do you think they would or should do? If they happen to be military what do you think would happen? Just because your DUI doesn't mean they need a radar gun or breathalyser equipment to know it.

I recall that, while trucking through North Dakota, near Minot, getting stopped on US #2 by an MP manned checkpoint. They did a vehicle inspection, checked my licence, authorities and logbook.

They were polite, efficient and very firm.

In 1991 during the LA riots the Marines deployed from Twentynine Palms under Presidential orders.

At the same time the California National Guard was deployed and the media reported the fact that the Guard was deliberately deployed without ammunition for their weapons. :roll:

Anyhow, some clown did a drive-by shooting on a Marine emplacement in Compton and got himself and his car shredded by a minigun.

The USMC spokesperson's comment to the local media: "He mistook the Marines for National Guard and likely will not do that ever again."

The point is that from time to time the military does deploy domestically. And when they do it's best to obey their orders because they don't play.
