They just reported on another case in Ontario where a cop was killed and the perp got manslaughter. So even tho the person is charged with first degree murder, it seems the jury has the option of giving a lesser verdict.

   

Judge or jury can always go up or down on charges laid.

   

Up as well? You sure? I don't think I've ever heard of that before.

   

I thought that the top charge was to be decided first and then the remaining charges if allowed by the judge could be considered, not the other way around

   

The kid broke his neck when the van rolled, the whole talk is moot. We're talking at how long he stares at what colour of wall for.
Circumstance dealt him a far crueler punishment than any court.

   

Nope, for the rest of his life anytime that he tries to do anything that involves getting run by the police for any reason, passport, cross the border etc. i should be flagged that he is a murderer. That will not happen if his convicted as a juvenile.

   

Question: How does this work if you have multiple passports? Obviously the kid doesn't, but for people who do and are flagged. Can they still use their foreign passports to move around without setting off flags?

   

I think the point is that the kid is now paralyzed. Whether he's convicted as a juvie or not, he's getting a far worse punishment than what the justice system usually would dole out. Karma did the job this time.

   

It's less prevalent than dropping down a peg but sometimes further evidence comes out at trial and charges are laid in court.

   

Oh Jeez, we can worry about that when the PC crowd makes all the rides at Disneyland wheelchair accessible, ok?
Who cares about crossing the border, God made sure this kid's gonna spend the rest fo his life wishing he could cross the room.

I thought that killing a cop was automatically first degree murder. So a life sentence.

If the kid didn't do it accidentally, he should get that.

   

I'm just happy he'll be shitting into a bag the rest of his life. His friends must think he's so cool now! He's the bad-ass that ran from the cops.

   

I'm sure he's regretting the whole thing during every waking hour OTI. This killing is such a tragedy on so many levels.
