Hum, we're making a storm about not much here.
Lemmy described the act that the guy as commited. It's not much, really not much...
That is why I don't get that they didnt keep it quiet...
Because the guy is famous, which will drag public attention and help them to sell newspapers.

Who said jail? he does deserve a criminal record and a few hours of counseling is probably a good idea.
If being a dickhead once was enough to get you a criminal record, there would not be many clean people around.

Ah, sorry, she was 16. According to that other thread, that is NOT a child!
We are going to have to agree to disagree on this one B. A 16 yr old is not yet legally or mentally/emotionally mature enough to consent to such behaviour
when it involves a person of authority! eg; teacher/student,IMO, still a child.
16 year old is not a child. Emotive issues aside, the fact stands that 16 year olds are legal to drive and legal to serve in the CF Reserves. You don't hand those to a child.

Being a dickhead doesn't deserve a record, sexual assaulting someone when your in a position of trust does.

The definition of sexual assault is way too vague here. I would classify his act as an act of grand douchebaggery, nothing more.
If we all just adopted the Christian side hug, this sort of thing would never happen.

You can consent to sexual activity if you are 14 to 17 years of age as long as:
no relationship of trust, authority, or dependency exists;
Which is where it becomes vague, don't you think? A 42 year old woman... Hmmm, I think she got his trust...
IMO, but it is another thread, she is abusing him. More than this guy abused this girl.

You're wrong as regards the law. And that's my criticism. An unreasonably frightened, neurotic, or intimidated person can successfully register a complaint of 'assault' based on no more than a touch. Of course, it is up to the police, then the local prosecutor, and ultimately the court to determine what might have been the 'nature' of the touch. My point is that many of these complaints and resulting criminal charges are a relatively recent phenomenon, which, imo, has more to do with a kind of paranoid social zeitgeist, and what has been called a 'culture of grievance', than it has to do with sensible and measured jurisprudence. The police and courts are REacting to a skewed and irrational public mood. It has happened before in history many times. The Salem Witch Trials were one famous instance.

I will consede that
legally 16 yrs is not a child.
Certainly not an adult either! A 16 yr old in the reserves would not be handed a rifle and 'full kit' and sent to Afghanistan. Would they?

Police are looking for a man who allegedly sexually assaulted a 12-year-old girl. (Edmonton Police Service) Police have released security footage from a city bus in their hunt for a suspect in a sex assault.
Edmonton Transit contacted cops about 10:18 a.m. Jan 1 to report the assault.
A 12-year-old girl had climbed onto bus No. 8 near 59 Street and 118 Avenue and was approached by a man.
He spoke to her briefly before "reaching out and allegedly touching her inappropriately several times," police said in a release.
Police said the suspect first got on the bus at 9:15 a.m. at 86 Street and 61 Avenue.
The man got off the bus after he was confronted by the driver. He was last seen walking along 118 Avenue, near 47 Street.
Cops were called to the area, but couldn't find the man.
He's described as dark-skinned and in his 20s. He stands about five-foot seven and weighs about 130 pounds.
He was clean shaven and was wearing a white ski jacket with grey patches over a white hoody. He was also wearing blue jeans and a grey toque.
Cops want anyone who has information on the man to call them at 780-423-4567 or Crime Stoppers at 1-800-222-8477
Do you suppose that when 'all is said and done' this cretin will be graanted an absolute discharge? Nah, I don't think so either.
Nor should he!
I am not sure what "Trust" means in the eyes of the law, I would think it would be the same as "authority" but they are both in there so I don't know exactly what the difference is in the eyes of the law?

Two things here that I am basing my opinion on is '
consent' and
person of authority. First and foremost, military service, and the danger involved, doesn't begin and end at the Afghan border, so your example is quite poor.
Secondly, the issue for you may be consent, but by the law, a 16 year old can make those decisions. You're applying the particulars of this case with your moral outrage on the law.
Donesn't work.

It does work because 'my moral outrage' doesn't figure in to this particular discussion ...a 16 yr old cannt 'give consent' to a person of authority or trust'.
ie; student-teacher relationships
always end in criminal charges and conviction for the teacher, regardless of the sex of the 'young person'.
What is age of consent alberta canada?
In: Alberta [Edit categories]
The age of consent in Alberta is the same as all over Canada:
If you are 12 or 13 you can consent to have sex with someone no more than two years older.
If you are 14 or 15 you can consent to have sex with someone no more than 5 years older (unless the two people are married).
The older person can NOT be a teacher, parent, guardian, doctor, etc.
For everyone else the age of consent is 16. But if the older person is a teacher, parent, guardian, doctor, etc, then the age of consent is 18.
The age of consent for anal sex is 18 unless the two people are married. Gay and straight marriages have been legal in Canada since 2005.
You know whats strange about this Yogi, if he would have done this to his secretary at work he would have lost his job.
Brenda @ Tue Jan 05, 2010 8:41 pm
Its kinda hard to fire your boss, isnt it. It was HER boss. If he did this to his secretary of his own company, and if she would press charges, she would lose her job, and his business would still exist.
Still, it is her word against his not knowing (or claim thereof).
