In hindsight if they knew this was the guy then they should have called the cops, then they would have to hope they get there before the guy steals more or just leaves. Then they have to convince the cops to detain the guy. Then they can finally show their evidence to the officers. My god what a farce.
I hope they manage to get this citizens arrest law expanded to give more power to average people. It makes no sence that the criminal can charge someone who apprehended him.

Chen, my man, Kudo's to you. I hope you win this case. You have the guy on tape, stealing. You catch him an hour later. Does that make it unlawful? I don't think so. It shouldn't be the way that you get away with theft over and over again, only because they don't catch you right at that moment.

So a murderer could kill, but it will only be a crime if he is caught doing it?
Tomorrow, it is not a crime anymore, not even when I have it all on tape, and ALL my neighbours recognize him doing it over and over again?

Holyyyyy fuckkkk!!! Some little shit gets off for doing 200+kph and this poor guy is getting railroaded for protecting his property. By the standards that have been set, if the police cuff you and throw in the back of the car, that's kidnapping and unlawful confinement then too right??
Makes me wonder if crack boy's daddy is/was a cop too :roll:

Your question does not relate to my claim about mens rea...

If a murderer had a plan to commit murder, it is murder no matter when they catch him. If he kills someone by accident or whatever without a plan to kill him, it is not murder, no matter when they catch him.

If a murderer had a plan to commit murder, it is murder no matter when they catch him. If he kills someone by accident or whatever without a plan to kill him, it is not murder, no matter when they catch him.

That is not the issue here. Maybe THIS time he didn't plan on it, but ALLLLL the other times, he did. That still makes him quilty of theft, no matter when they catch him.
Your mens rea doesnt fit here.
