PHOENIX -- Two 10-year-old boys charged in the alleged gang-rape of an 8-year-old Liberian girl must be released from juvenile detention and placed in therapeutic foster-care homes, judges ruled Tuesday.
Judge Aimee Anderson ruled that one of the boys is incompetent to stand trial and ordered him enrolled in a program that could render him fit for trial within six months.
Two mental health experts found the other 10-year-old incapable of becoming competent to stand trial within six months. Judge Dawn Bergin could order the charges against that boy dismissed at a future hearing.
Phoenix police allege the boys, along with a 13- and 14-year-old, lured the girl to an empty storage shed July 16 and raped her. All four of the alleged attackers are also Liberian immigrants.
Both boys must wear ankle bracelets to electronically monitor them while they are out of custody, and their families must surrender travel documents.
Anderson's orders brought an emotional response from one boy's family. His uncle told the judge he didn't want the boy in foster care, and other family members wept in court. One aunt yelled at the judge and pointed at her, prompting bailiffs to escort her out of the courtroom.
The boy also cried and told Anderson he wanted to go home; the judge tried to console him.
"Listen, you're going to be out of detention," she said. "You're going to be sleeping in a really nice bed."
The case sparked an international outcry after police reported the girl's father said she brought shame on the family and he didn't want her back -- comments a family pastor later said were misunderstood because of a language barrier.
State child welfare officials have custody of the girl.

Since the parents are not only obviously the cause of this tragedy but also unrepentent, I say charge them. Charles Manson was charged for ordering crimes to be committed and by proxy for brainwashing. I don't see the difference here.
Sounds reasonable. Even if they are not fit to stand trial at this point surely they just can't be released to wander the streets and do it again.

Agreed... The parents should be punished for their own inaction and what I would call piss poor parenting and teaching of treating others with the same respect you'd expect back and that you do not harm or kill others for your own sick pleasures.
At the very least, they should have taught their idiot children about Canadian laws and what is and isn't legal to do. If they can't understand or accept our laws when entering the country.... then don't allow them in.
Since they didn't, and they're supposed to be responsible for their childs' education and well being, they should be held liable.
And the children should get exactly what they're getting.... foster care while their brains get checked to determine if they'll be safe to re-enter society again some day.

why you worry about Canadian laws

Deport them back to Liberia and their Sharia courts........
If the kids can be fixed, keep them.
