That's just a regulation though. As we've all witnessed in the last two weeks laws, regulations, rules, mores, codes, standards, and anything else written on a piece of paper means jack shit when Freedom Lovers led by a Great Man decide that such trivialities don't apply to them.
It's not in the purvue of the US government to override Canadian law. To become effective, NAFTA II had to be approved by parliament.
True, but I'm skeptical that enormous political pressure won't arise in a few decades when the the Colorado River is a trickle and the Ogalla aquifer has been emptied by farmers. Agriculture is a huge industry in the US, with a very powerful lobby, and no politician is going to let a $300 billion industry die simply because the US doesn't have enough water, especially when Canada is sitting on far more than it can use for the foreseeable future.
At that point, someone in the USA is going to apply massive pressure for us to build some infrastructure to export some portion of our wealth in blue gold. I'd also bet that the business community will jump on it as a means of replacing energy extraction/refining revenues.
Heck, US engineers dreamed up these two schemes 60+ or so years ago, and I'd be surprised if one or both isn't at least partially built by their 100th anniversary (in about 40 years).
