$1:
(1) Parliament or the legislature of a province may expressly declare in an Act of Parliament or of the legislature, as the case may be, that the Act or a provision thereof shall operate notwithstanding a provision included in section 2 or sections 7 to 15.


(2) An Act or a provision of an Act in respect of which a declaration made under this section is in effect shall have such operation as it would have but for the provision of this Charter referred to in the declaration.


(3) A declaration made under subsection (1) shall cease to have effect five years after it comes into force or on such earlier date as may be specified in the declaration.


(4) Parliament or the legislature of a province may re-enact a declaration made under subsection (1).


(5) Subsection (3) applies in respect of a re-enactment made under subsection (4).

Well the final polls say Consveratives will win the most seats..

However a combination of Liberal and NDP seats would be higher than the Cons.....

So are we in for a coalition gov't between the Liberals and NDP?

It is the incumbent Prime Minister who has the first oppourtunity to approach the Governor General and make a proposition, right?



Relax and wait for the results Monday night. Don't count your chickens before they hatch!

LOL - What do you mean? You don't think the NDP would go for it? Jack can be minister of the war on climate change.....Paul will be PM of course....


Some of the comments you have said on here since your arrival are so far out to lunch.

And no, Layton wouldn't go with it. He can't bash the Liberals for 8 weeks and then get in bed with them. He'd lose the respect of his party.


Maybe you're right....but he also might be willing to do anything to prevent a Harper gov't....remember he is a Torontonian and thats what we do...


Layton has made some huge headway this election.

By getting in bed with the Liberals would set his party back. You can't tell people that something is bad for 8 straight weeks and then become best friends even if you don't like Stephen Harper.


When the NDP and liberals worked together on the budget last year Jack kept saying how terrible the liberals were while he worked with them....

All he has to do is spin it so that his people see him as getting the better part of the deal.....

Maybe Liberals give him proportional representation and Liberals get to have Prime Minister....I think he'd go for that....throw in some tuition cuts, toss some $$ at the homeless.....yeah, yeah we can make it happen....

except the only parties capeable of a majority coalition would be conservative-bloc liberal-conservative and liberal bloc none of which will ever happen except mayby conservative bloc

The notwithstanding clause is still unclear to me....it would appear as though it would have to pass through parliment. Which means they need a majority government, or I should say a majority of the government would have to pass it. Interesting....

And if Jack or Martin was at all smart they would at least TRY and make parliment work for a little while. If they do not they will be in the exact same position, and Canada will truly be pissed. It would seem that it will be a bumpy ride on parliment hill.

NDP 29 +

Soo....the prediction just needs to be off by 3 seats.....There is also one independant....Plus I'm sure we have a couple cons ready to cross the floor...

Yeah it would definately have to pass a vote in the house.....no way we would give that much power to one person.....this is a democracy, not america.
