Canada Kicks Ass
Deportation and serious crimes

Should permanent residents who commit serious crimes be deported to their country of origin? By serious crimes I mean murder, rape, kidnap etc. I have been trying to find statistics about this but have been unsuccessful.

Problem is that most of these people are refugees and will cry that they face discimination, prison or dealth if they are returned.

The way they can prevent that, is by becoming Canadian Citizens after 3 years.

So, yes. After they served their sentence.

Serve their sentence here? Why?
Unless it's labor to repay the victims, I see no profit in keeping them here.

Because the victims (or their loved ones) deserve that. They deserve their day in court. Deportation to say... Germany... Because that is where the murderer of your child came from... That would not feel really good, would it...
(OOOOOPPPPSSSSSS!!! emotional bullshit!!!! Beat ya to it, Roman ;-))

Victims want speedy justice and punishment. Even if they wanted revenge, they wouldn't get it from our system. Afer they hear that the criminal recieved appropriate punishment, they never want to see or hear from them again.
If the criminal in inturned in Canada, you an almost guarantee that the criminal wlll never be deported and the press will always be there for the paroll hearings. I would rather we craft up prisoner exchange rules with countries we take people from and return them to place of origin for an agreed prison term.
We take these people in the belief they are good, law abiding poential citizens. When they are convicted of a crime, they violate that contract.

True. And it clearly states that you will be kicked out of the country. At least, my visa says that...

The problem however (although I fully agree with what you say) is that you as a country, will never have such treaty (is that the right word?) with the country you really would want it with, because the sentences/punishments (or even prisons) are not alike. You could have it with western countries, but Asian countries (like Thailand, Indonesia), African or Middle Eastern countries would never agree.

$1:
Foreign Nationals
Foreign nationals are people other than Canadian citizens or permanent residents. The threshold for the possible deportation of foreign nationals is lower than that for permanent residents. A foreign national who is convicted in Canada of an indictable offence or of a hybrid offence (which is an offence that may be punishable by way of indictment or summarily) regardless of the length of the sentence, may become the subject of a deportation order (sections 36(2)(a) and 36(3)(a) of IRPA). A foreign national who is convicted of two or more summary offences, not arising out of the same incident, may also be subject to a deportation order (section 36(2)(a) of IRPA). Foreign nationals have the right to appeal a deportation order to the IAD only if they hold a permanent resident visa, or if they have the status of protected persons (which include refugees) (section 63(3) of IRPA).

Refugee Claimants
Permanent residents and foreign nationals who have been convicted of an offence in Canada for which they have been sentenced to at least two years of imprisonment are no longer eligible to have their claim for refugee protection referred to the IRB for a hearing (section 101(2)(a) of IRPA).

Writting it don't make it happen though.

Absolutely they should be.. problem is that they end up in the federal correction facility and they are given a social worker, get religion and hire a lawyer who delays deportation. I worked for Corrections and this was the case all too often.. there are hundreds awaiting so called deportation.. I left corrections in 97 and some of these guys are still in the system according to friends I have who still work there..
there are too many bleeding hearts that jump on the bandwagon to keep them here.. and yes the racist card is played in every hand...

If you commit any crime within a 10 year period it's out the bloody door and back to where ever the hell you came from. Can't go back because you pissed them off there? Tough shit, here's raft go find somewhere else to live.

Oh and if you're thinking of sneaking back in, if you're caught, you're shot on sight. No wasting our tax dollars or resources so you can sit in a nice cell talking to your buddies. [B-o]
