BeaverFever BeaverFever:
its not clear why the motorcyclist crashed into her.

Two cars in front changed lanes to avoid the stopped car, the bike was unable to react in time, as each car in front used most of their safety distance to react, the vision lines of the biker was blocked by the vehicle in front.

Bottom line the bike was too close to stop, which is astounding given how fast bikes can break.

Sorry. It's illegal to stop in the fast lane of a highway for no reason, and for good reason.
Which is a minor traffic violation with a fine under $200. Also their is no fast lane. Their is however left and right lanes of travel. That you think their is a go fast lane outside of limited mountain passing lanes speaks to your own bias.

She's an idiot who needs a judicial spanking. But when we've had killers (women of course), who meant to cause harm, get house arrest or probation, makes a good case that the jail portion of the sentence is too severe. Or the sentencing for those killers is too lenient.
Well I can agree with this point.

Doesn't matter who, what or why.
If you're driving fast enough to hit something dead stopped in the road, you're driving too fast for road conditions.
No excuses. Black Ice wah wah wah.
Nope. you're it.
And if you're going so goddam fast you kill yourself or your passengers, there ain't no doubt about it at all.
As for goody two-shoes give her the fine and the points and remind her of the public humiliation she just went though.

do you have a point?

Stopping on the highway without justification is a crime, a very minor one with a small penalty.

That she was convicted of 'Criminal Negligence Causing Death' is comical because the negligent party was the biker. So now we are holding people to be criminally negligent for the negligent actions of others.

That's fucked, the court is wrong and this is a huge blow to safe driving.

I guess now we should stop teaching people about following distances because you don't have to be able to stop in time. If you hit someone stopped in front of you THEY are the ones that are negligent.

Tailgaters, speeders and reckless drivers rejoice you are not at fault anymore. It's other people's legal obligation to make it safe for you to drive.

But don't worry the legal system has it covered, 'At that time, a Quebec judge ruled that Czornobaj could appeal her convictions.'

Denied an appeal to a higher court because? Reasons I guess. A criminal conviction for someone without any criminal intent. We should be making these judges account for their actions.
