well unfortunatly all of the above suggestions constitute assault... my house was broken into and the person who did it fell and broke his leg on my front porch... and guess what he sued... got an out of court settlement by the insurance company... I dropped them as an insurance provider... I told the cops I should have hit him with a bat and he told me I could have been charged with assault... sucks but that is the law I guess..
bad laws need to be changed, rather than accepted. As to the chunks of ice, they'd be hard to find in the snow.

No! That is not the law. That is how many judges have interpreted it and the Police support it to maintain their exclusive on the use of force. It's sort of theory and practice....

You do have the right to self defence. Then a judge and perhaps a jury of your peers will decide whether excessive force was used. That is the law.
Too often these days the determination of necessary force is established by subjective means rather than objective. Precedents such as your insurance provider settling sets a bad precedent---but sets a precedent non-the-less.
In the situation of the snowballers, the use of a hockey stick would be appropriate in that obviously one assailant was armed with a piece of pipe and another with a knife. The fact that the home-owner sustained grevous bodily harm, life threatening injuries, makes an armed response appropriate.
However, had the home-owner successfully used a hockey stick for example and prevented injury, he would have been pillaried for assaulting minors engaged in a trivial matter. The weapons these punks had and were prepared to use would have been dismissed in the process.
If these perpetrators had been apprehended they would be in line for many serious felony charges.
Possession of a weapon dangerous to the public peace, assault with a weapon, assault and battery with bodily harm, attempted man-slaughter........

Ahh Winnipeg, proud holder of the titles of murder capital of Canada AND car theft capital of Canada. I've been here for over a decade and will be happy to leave as well. Not that the city isn't great, it is. But, we have a real problem that has been compounded by the Youth Criminal (lack of) Justice Act. Even if they caught these kids nothing would be done, just as nothing is done when they steal cars, to put blocks of ice on the gas pedals and run them into buildings, or ram police cars, or a favorite last summer, run down joggers. They actually caught some kids that hit a jogger, but since they didn't hit the jogger head on, well they CLEARLY weren't trying to kill him, even if he did require three months to recover from the head injuries and broken bones. So the warning that was issued was the public was responsible because they were not securing their cars.....
Two punks were arrested by police for the attack on Denning.

On Saturday, police arrested two boys, aged 15 and 16. Both face several charges, including attempted murder. If convicted, they could face a maximum sentence of three years in prison.
Three fucking years for attempted murder.......at the most! No wonder the severity/level of violence of attacks involving teens is going up.
