Man convicted of child abuse exiled to Canada

Given a choice between jail and exile to Canada, an American man chose Fort Erie, Ont. after being convicted for having sex with a 15-year-old girl.


Starting Monday, Malcolm Watson will stay out of the U.S. for three years as punishment for having a sexual relationship with the Buffalo, N.Y. student.


The sexual abuse sentence handed down by a New York State court only allows Watson to re-enter the U.S. to report to his probation officer.


Watson, 35, lives in Fort Erie with his Canadian wife and three children.


The former seminary teacher was arrested in April after a mall security guard noticed Watson and the girl sitting in a parked car for two hours.


District Attorney Frank Clark called the sentence "a little dicey."


Immigration lawyers in the U.S. are questioning whether the court has the authority to banish a citizen, The Associated Press reported.


Watson's defence lawyer Oscar Smukler was reportedly surprised by the unusual sentence. He is concerned that his client's new criminal record could prompt Canadian authorities to deny Watson entry.


"We did some research on the question of whether Canada might consider throwing (Watson) out, which would make him a man without a country," Smukler told AP.


Watson did have a choice of sentence. His alternative was to spend a year in jail.

Does he have dual citizenship? That is an extreamly odd sentence to be given out. I've never heard of such a thing before from the US courts unless the person is a foreinger.

I have no idea why it happened ...but as far as i can tell "from whats posted about it" he is a U.S. citizen.
It no doubt has something to do with our version of homeland security"Stockwell Day" helping to keep Canadians safe :wink:

Just found this turns out he is a U.S citizen who already lives in Canada....maybe they should look a deporting him!

Former teacher banished to Canada

BUFFALO, N.Y. -- A former school teacher convicted of having sex with a 15-year-old student has been ordered by a judge to leave the United States for the next three years, returning only to meet with his probation officer.

Malcolm Watson, 35, agreed to the sentence to avoid as much as a year in jail after pleading guilty to endangering a child and third-degree sexual abuse - both misdemeanors.

Watson, a former teacher at the Buffalo Seminary, is a U.S. citizen who already lives in Fort Erie, Ontario, with his Canadian wife and three children. He was arrested in April after a mall security guard noticed the pair sitting in a parked car for two hours.

Erie County District Attorney Frank Clark called the plea deal "a little dicey" but said the girl's family was happy with it.

Watson's lawyer, Oscar Smukler, said he was surprised by the agreement and was initially concerned that Canada could deport Watson, making him "a man without a country." But Smukler concluded that Canadian officials would be unlikely to act because Watson's crimes were the least serious form of sex offense.

Great sounds like a plea bargin was put in. This means that the charges were worse but the lawyers hashed out some sort of deal and down graded the charges.

Canada now accepting U.S garbage - First thought this thread was about a democrat immigrating here.

I've made my beliefs regarding both straight and homosexual pedophiles (incarcerate forever or execute) well known, having said that I am not sure as to why people are confused. He is a Canadian by default having married a Canadian woman. People committing crimes and using Canada's lax immigration rules to their advantage is nothing new and so long as we who make the rules don't take Canadian citizenship seriously or assign it any real value I am not sure why foreigners should be expected to.

I don't blame the Americans for not bothering to seek extradition over this. In case after case Canada's taxpayers have fought the US tooth and nail to prevent American serial murderers and the like from being deported to the US where it is argued they will be treated improperly.

Weird...

He already lives in Canada full-time with his wife & child so its not exactly as if he's been "deported" to Canada... just sent back home.

I don't think that he should just be allowed to 'roam free' in Canada though... that seems odd. Although depending on the individual case, this might be effective enough, now that his name is spread all over the place, he'll have a hard time doing almost anything in society.

The Canadian Border Services Agency refused to discuss the case, referring all calls to the office of federal Public Safety Minister Stockwell Day. Calls to the ministry were not immediately returned.

The sentence will be rendered null and void if Watson is deported to the U.S., where he faces a year in jail.

Hey grainfed, how do you figure that he's a Canadian by default. He isn't, he still needs papers, being married to a Canadian doesn't make him a Canadian.. He should be deported immediately as a known pedofile, and that'll take care of the question of his citizenship! Give me a break!

I would certainly have to assume he had applied for and received at the very least, a spousal temporary resident visa which are refused by the feds about as often Vancouver's tax funded drug shooting gallery refuses to provide exchange needles.

And he doesn't have to married; common law or what ever passes as a legitimate family in the eye of the government is more than acceptable. Hell, gay or transgendered are even more desirable.
