Not only are these caps unjust and unfair, they are based on false information. Inflation adjusted injury claims have not been increasing over time, and thus were not a cause for the incresing insurance premiums. A report was written which showed this, but it was shelved and its author, Gordon Smith, wrongfully discredited. The Alberta Government may be able to plead ignorance when it wrote the law, but now that the facts have come to light, they had better not appeal this ruling.

If you want an example of how it should be done, the lowest insurance prices in Canada can be found next door in SK. No fault insurance! The only people it hurts are the lawyers.

I am paying 700 for an 05 Corolla and 950 for an 05 Honda Element,...500 deductible with no windshield coverage......I'm sure i would save "big bucks" in Saskabush

For those machines, you'll likely pay about the same, but in SK you'll have windsheild coverage.

Alberta isn't as bad as BC. ICBC is retarded. I don't know why the people havn't revolted out here.
I did pay more after moving to AB. And I know folks with farms in SK, but pretty much live and work in AB, all keep their SK plates. More affordable.

Before Alberta made the changes BC plates we're every where in Alberta , everybody under 25 from BC kept their plates for years , which of course was a risk if they had to make a claim. :

I believe it had to do with age or gender "discrimination". A lot of young males had their rates drop.
I agree with the judge. The law did discriminate against people with a specific type of injury. Had a broken bone occured from the same cause the cap would be lifted.

If they're making a killing, then it's by charging more to their clients. Alberta insurance rate increases were NOT due to injury lawyers, as such payouts did not increase over time. There is something else driving up the cost of insurance.
If lawyers are charging too much, their clients should take it up with them. The government shouldn't be putting caps on payouts for legitimate injuries based on faulty information.

Hey, I'm not going to argue with you, just trying to open your eyes. I don't have to pay Alberta insurance, doesn't affect me.
When they brought in no fault insurance in SK, the people screaming the loudest against it were the lawyers. That's when you know you're doing something right.
Lawsuits/lawyers drive up the cost of insurance. Same thing that happens with American style health care.

I had someone run into me while stopped at an intersection years ago, his insurance tried to argue that he was not at fault . My insurance company paid and fixed my vehicle right away and went after his insurance company.
And THAT is what your insurance company has to pay lawyers for. If it costs the insurance companies, in the end it'll cost you.
Moved back to Alberta from the Soviet Socialist Republic of Manitoba and am paying $550.00 less per year than with Manitoba Public Insurance AND with more coverage. All that happens there and elsewhere with public insurance is that moronic/chronic/thieving drivers get subsidized.
I will not pretend I have all the answers but I can tell you what i saw in Manitoba and it is godawful. What I found most repugnant were all the scams being pulled for new sleds, hogs and beater cars. I'd rather stick with private insurance. Sure it's buyer beware, but take the time to look around.

You didn't see insurance rates a few years ago before the cap was imposed.
