who the hell legally owns the Cup anyways?



Legally I believe the NHL are the keepers of the cup, they have controlled it since 1926.

EEEEEyah, didnt Canada make up most of the NHL by 1926? Also, what about Lord Stanelys family or whatnot? Dont they own the cup or something? or did hey give the rights to someone else?

Actually, the Memorial Cup is for all of CHL, that's the WHL, OHL and the QJMHL and ECHL I think (not positive on those last two). And the NHL is the gaurdian of the cup, I don't know who has legal rights of ownership on the Stanley Cup.

The ECHL is totally independant of the CHL, they are a minor league or a Semi-pro league that a lot of NHL and AHL teams use as a feeder system for their overflow players. Beginning with the 1996-97 season, the Patrick J. Kelly Cup is awarded annually to the playoff champion of the ECHL.

I am pretty sure the NHL is the leagal guardians of the cup, it is just that the Hall of Fame are the keepers of the cup so to speak.

It all started on March 18, 1892, at a dinner of the Ottawa Amateur Athletic Association. Lord Kilcoursie, a player on the Ottawa Rebels hockey club from Government House, delivered the following message on behalf of Lord Stanley, the Earl of Preston and Governor General of Canada:


"I have for some time been thinking that it would be a good thing if there were a challenge cup which should be held from year to year by the champion hockey team in the Dominion (of Canada).
"There does not appear to be any such outward sign of a championship at present, and considering the general interest which matches now elicit, and the importance of having the game played fairly and under rules generally recognized, I am willing to give a cup which shall be held from year to year by the winning team."



The Stanley Cup was originally known as the Dominion Hockey Challenge Cup
Shortly thereafter, Lord Stanley purchased a silver cup measuring 7 ½ inches high by 11 ½ inches across for the sum of 10 guineas (approximately $50); appointed two Ottawa gentlemen, Sheriff John Sweetland and Philip D. Ross, as trustees of that cup; and set the following preliminary conditions to govern the annual competition:

The winners to return the Cup in good order when required by the trustees in order that it may be handed over to any other team which may win it.

Each winning team to have the club name and year engraved on a silver ring fitted on the Cup.

The Cup to remain a challenge competition and not the property of any one team, even if won more than once.

The trustees to maintain absolute authority in all situations or disputes over the winner of the Cup.

A substitute trustee to be named in the event that one of the existing trustees drops out.

This is the obituary of Archibald Bennitz, first published in the Ottawa Citizen on Thursday, January 20th, 2005.

"BENNITZ, Archibald (Archie) Wednesday, January 19, 2005, at the age of 84. Predeceased by his wife Vicky, Archie was the beloved father of son David and daughter-in-law Wendy and a wonderful grandfather to Joshua, Michael and Adam. He leaves behind his brother Doug in B.C. and many nephews and nieces.

Archie was born in Amherst, Nova Scotia and served overseas with the 422nd Squadron RCAF, in WWII. A long-time resident of Niagara Falls, Archie was an avid fan of watching hockey. He asked that Mr. Bettman and Goodenow know they are "skunks" for denying him the pleasure of watching the NHL on TV this year. He also asked that Mr. Bettman steps aside and gives Wayne Gretzky the job that rightfully belongs to him.

Special thanks to Dr. Yahyavi, Ellen, and the nurses on the 4th floor of the Queensway Carleton Hospital for their caring and compassion. At Archie's request he is being cremated and a private family gathering will be held. In memoriam donations to the Canadian Cancer Society would be appreciated."
