A poor pizza delivery guy was killed for just that reason except it was california. That man should have gone down but he walked scott free.

His actions were definately misguided. i understand what he was thinking but and why he would think this was a good idea but he lost sight of what was really important.
Its very sad because that night he made one very bad decision and it cost him his life too.

It wouldn't happen. They were coming into his yard after stealing from his neighbours house. There is a bit of a difference.

Are you so sure about that? I read assurance in that statement yet you must recall the general locale of the shooting? Pasadena is a suburb of Houston, Texas, USA. And in the great lonestar state they tend not to charge folks like the Pasadena man because of their largely Old Testament view of Law and Order. He may yet go to jail, just don't expect a severe sentence, if even he gets that.

Did he not hear the 911 operator repeatedly tell him to stay in house and wait for the cops? Even so, at he very least he could have waved his shottie in the air and told the thieves to kiss the dirt until the cops arrived instead of murdering them.
Back home in Canada you cannot but in the USA, especially Houston, TEXAS? Oh yeah, you can do it far easier than I think you would like to believe. Life's cheap here and the law is read with an eye-for-an-eye slant.
Specifically though. Let me walk you through a situation I actually had to deal with as a probation officer. I recently buried one of my kids because, he was of all things, stealing someone's property. It was a house, it was dark and at night and the homeowner was armed. Guess what? The world's now minus one 14 year old black kid because of a .40 caliber handgun. Did the owner even get a clear look at the kid? No. And he didn't need to according to the law.
If he saw so much as a friggin shadow he could shoot to kill. Even if the kid was a mentally retarded 14 year old homosexual boy. Special status and youth will NOT protect you in this state. Do something wrong and you will get shot dead. I tell this to all my kids so that they have NO DELUSIONS about the dangers of robbing a homeowner in Houston. Oh, by the way, the kid's family can't even sue the homeowner in civil court since the homeowner was acting in his self defence.
And under special circumstances you CAN shoot to kill a intruder on your neigbour's property in Texas. Xerses, this ain't Canada. It's Texas. You can get killed DAMN easy here if you are stupid. The 911 operator was probably telling the guy not to shoot the intruders since most intruders in Texas come in armed. Most of them are armed with more than just a shotgun or handgun. In most situations the old man would have been killed for his vigilante antics. A Texan, especially a Houston area 911 operator doesn't usually care about the bad guys and was (I'd bet good beer and steak on this) not concerned with bad guys but hoping this "good-ole'-boy" didn't get hurt. I know that's hard to swallow, but it is a very different world in some ways down here.

Personally Lily if I was him, i wouldn't of done what he did. According to what i've read he's regretting his actions now , his concious has kicked in.
On the other hand, if I was in my own house and I suprised some robbers weapons or no weapons and they lunged at me I'd blow the fucker away. And I'm pretty sure I wouldn't loose any sleep over it.

This was on the news before and if they were stealing from his house he would not have been charged, however he was not protecting his own home. You can't go around shooting people in the neighbourhood if they are not robbing you, if that were allowed to happen chaos would ensue everywhere

I probably would. But self defense is acceptable. What this guy did is closer to murder.

I would not be so quick to jump to that conclusion. A jury in Texas will not be so quick to find him guilty even if the judge goes to the extraordinary step of instructing the jury to find for guilt.
More likely the DA will plea bargain this down to a misdemeanor.

Why not? Criminals are perfectly willing to use deadly force to

You're probably right. But considering the leeway that is given to Texans in regard to protecting themselves and their property, he still managed to go over the line in this case and needlessly take two lives.
