OK, so he's now been charged with criminal negligence causing death and dangerous operation of a motor vehicle causing death.

When I first heard this story, I thought this was another politician DUI but after reading the details, I don't see how they'll convict him unless they find alcohol or they have footage of him deliberately hitting the guy or something. Otherwise, they'll have to prove that he deliberately slammed the biker into those obstacles but based on what they've released so far, I think Bryant's defence will go like this:

" I got into this traffic-related argument with a big, younger guy. I remained in my vehicle but he then attacked me and tried to jump in my car. In fear for my safety, I drove off with my attacker still hanging on. He grabbed [my face or my arm or the steering wheel] and I [ lost control and/or couldn't see and/or tried to swerve around the construction crew and lost control] and crossed the centre-line, crashing into trees and a mailbox. When I saw he was no longer on the car, I stopped immediately at a safe location less than a block away and called 911."

People who get into trafic altercations are generally assholes anyway. I understand why someone wouldn't want to let go of a speeding car, but what kind of prick jumps on one to begin with?

Reguardless of how stupid they might be, it's still illegal to run them down, and you must stop at the scene of an accident. While there may be some provocation involved, it sounds more like 2 big scoops of entitlement.

That's jail time right there if there is a conviction. I'm thinking 2 years less a day, open prison (Club Fed-ish).

Doesn't sound like he ran the guy down, sounds like the biker jumped on his car and he sped off with the guy hanging on to his car. And he didn't go home, he parked less than a block away and called 911. This isn't a Chappaquiddick incident where he went home and didn't call police. You'll notice he's not charged with fleeing the scene.

Like I said, they'll have to prove he was boozin or that he deliberately crashed into those obstacles, or that he was somehow holding onto the guy or the guy was unable to freehimself. Otherwise, I see a big not-guilty verdict.

I've witnessed something similar while driving in Vancouver a few times. A cyclist getting pissed off at a driver and grabbing onto a mirror or roof rack while screaming at the driver or pounding on the side of the vehicle. This sounds like a road rage incident gone sideways. The fact he was a former politician probably has nothing to do with it.

I think BF sends a good prelude of what is to come...

unless some really weird video comes out, I smell a walk.

He may have just had the shit scared out of him and reacted. Some people don't handle adrenaline very well.

Crim neg cause death is a tough one to prove, even dangerous drive isn't easy. Get a jury and I can already hear 'reasonable doubt'.

Its unfortunate that someone died because of this but either way the cyclist shouldn't of latched on to the speeding vehicle and the guy driving should of stopped when he did.

Cyclists and motorists need to calm the fuck down.

EyeBrock @ Tue Sep 01, 2009 2:35 pm

This whole road rage thing needs to be viewed in the same way as the now taboo matters such as domestic violence and impaired driving is.

People seem to think it's ok to try and maim people for cutting them off. Too much of this stuff on the go. A couple of months ago a crazy guy in a Saab tried to run me and my 3 year old off the road because I signalled a lane change late.

That would be the most stupid thing to do...

ALWAYS bring pen and paper with you to write down license plate numbers...

I dont think there are any cycling shorts that have a pocket to accommodate a pen and paper [huh]

I carry it in my panier (saddlebags), along with my wallet, a cell phone and a bottle of water.

On CTV news. Seems like the cyclist may have been drunk. Police were called to a disturbance at his house two hours before, said the guy was drunk.

OnTheIce @ Tue Sep 01, 2009 8:04 pm

Knowing the way these guys bike in Toronto, and the fact that he was drunk, I wouldn't rule out that the guy went nuts on Bryant, perhaps threatened him and being a politician he was scared to death, and he panicked and tried to get this drunk guy off the side of his car.

Brenda @ Tue Sep 01, 2009 8:20 pm

Which is not an excuse...

Let's lay down a scenario Brenda,

You're with your friend in Toronto, driving your convertible with the top down at night.

You have a collision with a cyclist who smells and talks like he may be intoxicated, perhaps he threatens you and holds onto your car. He's inches from your face and won't leave.

You have no window to defend yourself as they roll up too slow and your top is down so the guy, if he wanted to hurt you, could reach over the window or around the window.

Point being, you don't know how you'll react until you're in a situation like this.

Without knowing the whole story, it's hard to say what's a valid "excuse". Bryant had a passenger, it should be interesting what she says happened.
