When the person that called 911 said he thought the pistol was a fake, and the age of the victim maybe a watch and shoot action would have saved a life.

N.Y. cop not indicted in choke hold death

A grand jury in New York on Wednesday decided not to indict white police officer Daniel Pantaleo in the July choke hold death of Eric Garner, an unarmed black man, according to two law enforcement officials.

During the fatal encounter July 17 Garner raised both hands in the air and told the officers not to touch him. Seconds later, a video shows an officer behind Garner grab him in a choke hold and pull him to the sidewalk, rolling him onto his stomach.

"I can't breathe! I can't breathe!" Garner said repeatedly, his cries muffled into the pavement.

The cause of Garner's death was "compression of neck (choke hold), compression of chest and prone positioning during physical restraint by police," the medical examiner's office has said. The death was ruled a homicide.

The New York City Police Department prohibits choke holds.

Garner, 43, was pronounced dead that day. Police had suspected Garner of selling cigarettes illegally.

It's funny because in 2010 at the federal level prosecutors had about 165,000 cases go to grand juries to see if charges should be filed. They rejected 11 cases.

I sincerely hope he dies a slow and miserable death. Pancreatic cancer would be fitting.

Accidents happen. Had they subdued him and put their knee on his neck, the result could have been the same.

But since we don't have the full video and want to ignore the lengthy criminal history, the outrage will continue.

The man did not need to be subdued for a simple misdemeanor. A citation should have been written and then it would have been over and done. Instead some Neanderthal decided to escalate this far beyond what it should have been.

And the decedant's criminal history is irrelevant because it wasn't the decedant who killed someone in this needless confrontation.

Let's say you're a habitual speeder and you've got thirty misdemeanor speeding violations on the record...does that excuse a cop for jumping you from behind and then killing you? Of course not.

As I said in the other thread today the situation isn't going to change until municipal, county, and state governments quit using the police as tax collectors via fines to generate revenue. And the austerity-driven slashing of police budgets absolutely has to stop if they want to maintain a level of professionalism and training.

Bloomberg's long gone BTW in NYC. Despite his lefty blather during the 2012 election DeBlasio hasn't done SFA to rein in the NYPD because, like Bloomberg, he found out how dependent the city's become on the revenue the police are generating with the zero-tolerance fining policy that the police have been saddled with.

Did the cop ask me to put my hands behind my back and I refused? Did I tell the cops to leave me alone and refuse to comply?

Why do you keep leaving the part out? Why does everyone leave out that part? You don't get to decide when and where you listen to police, especially when you're a habitual criminal.

The guy was a massive dude that refused arrest and died cause he was tired of being "harassed" for being a criminal.

Too bad for him.
